The adequacy assessment of the Code of Practice on Transparency of AI-Generated Content has concluded. The European Commission adopted its Opinion on 8 July 2026 and the AI Board its Adequacy Assessment on 9 July; both were published on 9 July. The code is now the confirmed EU-wide adequate instrument for Article 50(2), (4) and (5) of the AI Act. Providers that do not sign have to demonstrate adequacy separately to each national market surveillance authority. The deadline for initial signatories is 22 July 2026 at 18:00 CEST.

The Commission's FAQ adds three points. Article 50 is not covered by the Omnibus stop-the-clock, so the date of 2 August stands. Generative AI systems placed on the market before 2 August have until 2 December 2026 to meet the marking obligation. Content generated and published before 2 August never requires retrospective labelling.
