The European Economic and Social Committee adopted its exploratory opinion on the Digital Fairness Act, INT/1132, on 21 October 2026 at its 609th plenary session. The rapporteur was Oleg Roibu of the Employers' Group, from Romania.

The key points on the committee's page ask the Commission to clarify influencers' obligations under the Unfair Commercial Practices Directive to disclose commercial communications, to prohibit the promotion of harmful products, in particular to minors, and to introduce an EU definition of "digital influencer". They also call for fairness by design and for a reassessment of the "average and vulnerable consumer". The key points do not mention dark patterns, virtual currencies or subscriptions.

On timing, MLex reported on 29 September that the Commission had tentatively listed the Digital Fairness Act for its 11 November meeting and that the schedule can change. A European Parliamentary Research Service briefing of 5 October says the proposal is expected in the fourth quarter of 2026, with current information pointing to mid-November.
